1. Acceptance of Terms

By accessing or using the MYAIRA platform (including MedixShare and MYAIRA AI), operated by AI Bharata, you agree to be bound by these Terms of Service. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Services

MYAIRA provides two core services:

• MedixShare: A medical image sharing platform that enables healthcare providers to securely share DICOM, X-ray, and other medical imaging files with patients and colleagues via SMS, email, or WhatsApp.
• MYAIRA AI: An AI-powered medical imaging analysis service that provides computer-aided detection of pathologies in medical images. AI results are intended as a clinical decision support tool and do not constitute a medical diagnosis.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to:

• Use the services for any unlawful purpose
• Upload content that infringes intellectual property rights
• Attempt to gain unauthorized access to other users' data
• Reverse engineer, decompile, or disassemble any part of the platform
• Use the AI analysis results as the sole basis for clinical decisions without professional medical judgment
• Share login credentials or transfer your account to another party

5. Medical Disclaimer

MYAIRA AI is a clinical decision support tool, not a diagnostic device. AI-generated analysis results are intended to assist qualified healthcare professionals and should never replace professional medical judgment. AI Bharata does not provide medical advice, diagnosis, or treatment.

The AI models are currently undergoing regulatory clearance processes. Accuracy metrics cited on our website represent validation study results and may not reflect real-world performance across all patient populations and imaging conditions.

6. Data Ownership

You retain all rights to the medical images and data you upload to our platform. By using our services, you grant us a limited license to process your data solely for the purpose of providing the requested services (sharing, analysis, storage).

We will not use your medical data for AI model training without your explicit, documented consent. Enterprise customers may opt in to anonymized data contribution programs under separate agreements.

7. Subscriptions and Payment

MedixShare scan sharing is free. Paid plans (Professional, Enterprise) provide additional features including AI analysis credits. Subscription terms, pricing, and credit allocations are as described on our Pricing page.

Paid subscriptions auto-renew unless cancelled before the renewal date. Refunds are available within 14 days of purchase for unused credits. Contact billing@aibharata.com for refund requests.

8. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. Enterprise SLAs are governed by separate agreements.

9. Limitation of Liability

To the maximum extent permitted by law, AI Bharata shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the services. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

We are not liable for clinical decisions made based on AI analysis results. Healthcare professionals are solely responsible for their clinical judgment and patient care decisions.

10. Intellectual Property

The MYAIRA platform, including its software, AI models, design, and documentation, is the intellectual property of AI Bharata. You may not copy, modify, or distribute any part of our platform without written permission.

11. Termination

We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the services ceases. We will retain your data for 90 days after termination to allow data export, after which it will be permanently deleted.

12. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

13. Changes to Terms

We may update these terms from time to time. We will notify registered users of material changes via email at least 30 days before they take effect. Continued use after changes constitutes acceptance.
